Request deletion of Naughty AI data

This Deletion Policy explains how users of Naughty AI (the “App” or “Application”) may request deletion of personal data and related records, and how Dong Phat Solutions Co., Ltd (together, “we,” “us,” or “our”) processes those requests. It is intended to meet Google Play data-deletion requirements and to align with applicable privacy laws, including GDPR, CCPA/CPRA, LGPD, and similar regulations.

2. What Data May Be Deleted

Subject to applicable law and the exceptions described below, users may request deletion of the following categories of data associated with their use of the App:

1. Creative materials and generated works: Images uploaded for AI creation and AI-generated images or videos stored on the user’s local device. Cloud cache used for real-time AI creation is temporary and is automatically cleared after creation is completed.
2. Device and App information: Device identifiers, App installation information, running logs, and related operational data stored on our servers (if any).
3. Service interaction data: Feature operation records, style-selection preferences, creation records, and service-usage duration associated with your device.
4. User inquiry data: Messages and contact information voluntarily submitted by email for customer support or rights requests, when no longer needed for handling the request.
5. In-app purchase records (where deletable): Transaction-related records we store for entitlement verification and after-sales support, except where retention is required by law, payment platforms, accounting, or dispute resolution.

3. How to Submit a Deletion Request

(A) Online Deletion Request Form

You may submit a deletion request using the Delete Data Request form at the top of this page. After verification, we will process eligible data deletion in accordance with this Policy.

(B) Self-Service Deletion on Device

You may take the following actions at any time:

1. Clear App cache / local data: Use your device system settings to clear the App’s cache and storage data, which removes local creative materials, generated works, and local usage records stored by the App.
2. Revoke permissions: In phone system settings, disable the App’s access to the photo library, storage, and device-information permissions to immediately stop further collection of the corresponding data.
3. Uninstall the App: Uninstalling the App will terminate local data collection and cloud synchronization related to the installed App. Local App data on the device will generally be removed with uninstallation, subject to your device system behavior.

(C) Manual Deletion Request by Email

You may also send an email directly to [email protected] with the subject line:

Subject: Naughty AI Data Deletion Request

Please include the following information to help us verify and process your request:

1. Your request statement, such as “Please delete my Naughty AI personal data”;
2. Your User ID (copy from App Settings) and/or other relevant device identifiers;
3. Google Play order ID if related to purchases (if available);
4. Approximate time period of App usage (if available);
5. Contact email for receiving our response.

We may request limited additional information solely for identity/device verification and to prevent fraudulent deletion requests.

4. Processing Timeline

1. We will acknowledge and begin reviewing your deletion request after receiving a complete request.
2. We will complete verification and provide a formal response within 15 business days.
3. After verification, we will delete or anonymize eligible personal data within a reasonable period, and in any event no later than the time limits required by applicable law.
4. Temporary cloud cache used for AI creation is automatically cleared after creation is completed and does not require a separate deletion request.

5. Data That May Be Retained

Certain data may be retained for a limited period where retention is necessary for legal, security, or operational reasons, including:

1. Data required to comply with applicable laws, regulations, audits, tax, or accounting obligations;
2. Transaction records required by Google Play, payment service providers, or for fraud prevention, chargebacks, and dispute resolution;
3. Data necessary to establish, exercise, or defend legal claims;
4. Anonymized or aggregated data that can no longer reasonably identify you, which may be retained for product analytics and service improvement.

When retention is required, we will retain only the minimum necessary data and will permanently destroy it after the statutory or necessary retention period expires.

6. Effects of Deletion

1. After deletion is completed, eligible personal data associated with your request will no longer be available for retrieval.
2. Because the App has no account system, deletion will not involve closing a registered account. However, related entitlements stored on the device may become unavailable if local data is cleared or the App is uninstalled.
3. Deletion of data does not automatically cancel completed in-app purchases processed by Google Play. Refund requests remain subject to Google Play Policies and our User Terms.
4. If you continue to use the App after submitting a deletion request, new data may be generated through your continued use.

7. Region-Specific Rights

Depending on your location, you may have additional rights related to deletion or erasure under laws such as GDPR, LGPD, CCPA/CPRA, and VCDPA. Exercising deletion rights is free of charge and will not result in discriminatory treatment. 8. Opt-Out of Data Sharing / Transfer

If your request concerns terminating data sharing or opting out of data transfer rather than full deletion, please email [email protected] with the subject “Terminate Data Sharing / Opt Out of Data Transfer,” and include relevant device identifiers. We will complete verification within 15 business days and permanently terminate eligible sharing and transfer activities.

9. Updates to This Policy

We may update this Deletion Policy from time to time based on product changes, legal updates, or Google Play compliance requirements. Updated versions will be posted through the App or on the relevant policy page and will take effect as of the date of publication.
